Abstract
This article analyzes the steps the creditor needs to take to ensure that the debtor can be sued for a deficiency judgment despite non-compliance with Part 5 of Article 9 of the Uniform Commercial Code. Under a recent Arkansas Supreme Court decision, Rhodes v. Oaklawn Bank, the first question that needs to be addressed is whether there is a right to a deficiency judgment at all.
